Terms of Service

1. The service

RadWorks is a service. We build a custom web app for your business, host it on our servers, run it, and improve it every month. The app is provided to you as a service for as long as your subscription is active. It is not sold to you as software to take away.

2. Accounts and access

You must give accurate information. You are responsible for keeping your login details private and for what the people you give access to do in your app. Tell us right away at chris@radconsultants.com if you think someone has gained access who should not have.

3. Plan, blueprint and pricing

The interview on this site produces a blueprint, which is the plan for your first month. You see the blueprint before you pay anything.

RadWorks is a flat monthly subscription of $1,500 per month, billed by Stripe by card. There is no setup fee, no hourly billing and no change orders. It is month to month and you can cancel at any time.

If a free period, promo code or guarantee is shown at checkout, it applies as described there. Your card is required at checkout, and charges begin when any free period ends unless you cancel first.

Month-one guarantee. If month one doesn't save you more than it cost, tell us within 30 days and we refund it. Month one is the first 30 days after your first charge. You then have 30 more days to email chris@radconsultants.com and ask. We refund that first month's fee in full, to the card you paid with. You do not have to prove anything; your word is enough. The guarantee covers your first month's fee once per business.

Fees are in US dollars and do not include taxes. Where required, Stripe collects and remits them. Failed payments get a 7 day grace period. Continued non-payment may lead to suspension of your app. Apart from the month-one guarantee, refunds are given at our discretion, case by case.

4. Canceling

You can cancel at any time by emailing chris@radconsultants.com. Cancelling stops future charges. We may end the service for a client who breaks these Terms.

Before or after you cancel, an admin on your account can download all of your data in one file from the What shipped page of your RadWorks portal, or ask us and we send it. We keep and then delete your data as described in our Privacy Policy.

5. Your data

Your data is yours. You give us a limited right to store and process it only to provide RadWorks to you. We do not sell it and we do not use it to train AI models. You are responsible for having the right to put your data into the app, including any consents you need from the people it is about.

6. Our work and your app

We keep ownership of the RadWorks platform, our templates, tools and methods, and the code we write to run your app. While your subscription is active, you may use your app for your own business. We may reuse general know-how we learn, but never your data.

7. Acceptable use

You may use RadWorks only for lawful purposes. You may not use your app to break the law, to send spam, to harm others, or to attack or probe our systems or those of other clients.

8. AI and your review

We use AI tools to help plan and build. We test changes before they go live. AI output can still contain mistakes. Please review what we ship and tell us if something is wrong. We will fix it.

9. Going live is your decision

Your app, and each change to it, goes live once it passes our tests. You decide whether your app or a change is ready to use in your business. That includes using it with your customers or the public, with money (bank accounts, card payments, invoices, payroll, prices), and with information or activities that a law or regulator covers (for example health, financial, personal or employee records, accessibility, and the rules of your industry).

You are responsible for that use and for your own compliance with the laws, regulations and card network rules that apply to your business. We do not give legal, financial or compliance advice. Our tests check that the software works as planned. They do not check that it meets a law or regulation.

Before you subscribe, and each time you ask for a change, we ask whether it reaches people outside your company, touches money, or involves something regulated, and we record your answer and your acceptance of this section. A change you mark gets an extra review from us before it goes live. That review checks that the build works; it does not move the decision to us. Check each change when it lands and tell us right away if something is wrong.

10. Connections to other systems

If we connect your app to another system you use, we do it with the access you give us. We are not responsible for outages, changes or limits in that other system.

11. Disclaimers and limit of liability

RADWORKS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAD CONSULTANTS' TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO RADWORKS WILL NOT EXCEED THE FEES YOU PAID IN THE 3 MONTHS BEFORE THE CLAIM.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

12. Indemnification

You agree to defend and hold harmless Rad Consultants and its owners from claims, damages and costs that arise from your use of the service, your decision to put your app or a change to it into use, your data, your breach of these Terms, your failure to follow a law or regulation that applies to your business, or your violation of another party's rights.

13. Changes to these Terms

We may update these Terms. If a change is material, we will email you at least 14 days before it takes effect. Continued use after that date means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of law rules. Disputes will be heard in the state or federal courts located in Bucks County, Pennsylvania.
